What is the same everywhere
Class E, Part 1, Schedule 2 of the General Permitted Development Order 2015 limits an outbuilding within 2 metres of the garden boundary to 2.5 metres in height, and limits all buildings, enclosures and containers to 50% of the curtilage, excluding the original house. See the clause on legislation.gov.uk.
The Building Regulations 2010 (Schedule 2, Class 6) exempt a detached building of no more than 15m2 with no sleeping accommodation, and a single-storey one of no more than 30m2 with no sleeping accommodation that is at least one metre from the boundary or substantially non-combustible.
What changes from one borough to the next
The local variables are designations and practice: conservation areas, Article 4 directions that remove permitted rights, and how the council handles certificates. Our analysis of MHCLG planning application statistics, table PS1, counts 84,906 certificates of lawful development decided by all English local planning authorities over the eight quarters from 2024 Q3 to 2026 Q2, so a certificate is a routine application, not an unusual one.
The pages below cover the local checks for each council. Read our guide on whether a garden room needs planning permission for the full checklist.
