Planning and building regulation drawings in Forty Hill (EN2)

Forty Hill is a village on the rural edge of Enfield. Georgian and Victorian cottages and villas are strung out along Forty Hill and Baker Street, close to Forty Hall, built in the 1620s and listed Grade I. Beyond them lies Clay Hill, a largely rural, semi-open area of only around sixty houses set among paddocks and public open space rather than a street of terraces. Bulls Cross is among the district's other roads.

That setting changes what a homeowner can realistically ask for. Two conservation areas, Forty Hill and Clay Hill, cover the village and its surroundings, and Enfield's 2009 Article 4 directions withdraw permitted development rights there, so alterations to a house, a boundary wall or an outbuilding can all need an application. A garden room or a new gate is therefore not a trivial matter. The Green Belt and the parkland of the Forty Hall estate sit around the edges, which limits how far a rear or side extension can grow on plots that back onto open ground.

Each scheme here begins with a proper reading of the designation, the listing position and the Green Belt line. Matching the materials of the older houses, keeping roof forms in proportion and respecting the original footprint are the points the drawings have to address. We draw to that picture, and flag early if part of a wish list is likely to conflict with it.

Planning in Forty Hill: what to know before you apply

In the Forty Hill and Clay Hill conservation areas Enfield has withdrawn permitted development rights through Article 4 directions made in 2009, so alterations to houses, boundary walls and outbuildings that would elsewhere be permitted need a planning application. We check the exact rights each direction removes for your address. Separately, conservation-area status means side extensions, roof enlargements and rear extensions of more than one storey are never permitted development. Works affecting the character of a listed building need listed building consent, and Forty Hall itself is Grade I listed. Green Belt policy applies to properties within it and limits the scale of extensions. Enfield also holds a borough-wide direction on HMO conversions, relevant only if three to six unrelated people would share. A planning application needs an ownership certificate or notice, not the freeholder's consent.

  • A single-storey rear extension up to 4 m deep on a detached house, or 3 m on any other house, is Class A permitted development subject to the height and materials conditions.
  • An Article 4 direction applies here and may withdraw this freedom — the schedule must be checked before relying on it.
  • One or more constraints are unknown — we check the council's registers as part of the free appraisal.
  • Where permitted development applies, a lawful development certificate proves it for lenders and buyers.

FAQ

Forty Hill (EN2) — FAQs

Can I build a garden outbuilding in Forty Hill?+
Probably not without an application. Enfield's directions for the Forty Hill and Clay Hill conservation areas take away permitted development for outbuildings as well as for alterations to houses and boundary walls. Green Belt and parkland setting can also be material. We check the exact designation first.
Will the Green Belt stop me extending?+
It does not rule extensions out. Where a house is in the Green Belt, national policy allows an extension that is not disproportionate to the size of the original building, so the design has to be sized with that test in mind as well as the garden length.
